Energy Audit Exemptions for Local Law 87

No energy audit is required if:

  • The commercial building has received an ENERGY STAR® label for at least two or three years preceding the filing of the energy efficiency report.
  • There is no EPA Energy Star program for that building type and a registered design professional certifies that the building’s energy performance is at least 25 points above the average Energy Star performance of that building type under the LEED2009 rating system for Existing Buildings or an equivalent (as determined by the Department of Buildings).
  • The covered building has received a LEED for Existing Buildings certification within the four years prior to filing the building’s energy efficiency report.
  • The building is in compliance with 6 out of the 7 items as certified by a design professional:
  1. Individual heating controls (thermostatic control per dwelling unit, building, or energy management system)
  2. Common area and exterior lighting
  3. Low flow faucets and shower heads
  4. Pipe insulation
  5. Domestic hot water
  6. Washing machines
  7. Cool roof

Retro-Commissioning Exemptions for Local Law 87

Buildings do not require retro-commissioning if the building has received a LEED 2009 for Existing Buildings certification within two years prior to the report filing year and both the LEED point for Existing Building Commissioning analysis and Existing Building Commissioning implementation.
